John the Baptist / Yahya ibn Zakariyya
Most westerners don’t have a clue that John the Baptist, as well as Jesus, are featured prominently in the Qur’an.
Today’s reading in The Lectionary starts of the magically lyrical Book of John, and, if you read between the lines, you get a clue to the mystery of the holy trinity – not three Gods, not at all, but three facets of the one God we people of the book believe in:
John 1:1-18
1In the beginning was the Word, and the Word was with God, and the Word was God. 2He was in the beginning with God. 3All things came into being through him, and without him not one thing came into being. What has come into being 4in him was life,* and the life was the light of all people. 5The light shines in the darkness, and the darkness did not overcome it.
6 There was a man sent from God, whose name was John. 7He came as a witness to testify to the light, so that all might believe through him. 8He himself was not the light, but he came to testify to the light. 9The true light, which enlightens everyone, was coming into the world.*
10 He was in the world, and the world came into being through him; yet the world did not know him. 11He came to what was his own,* and his own people did not accept him. 12But to all who received him, who believed in his name, he gave power to become children of God, 13who were born, not of blood or of the will of the flesh or of the will of man, but of God.
14 And the Word became flesh and lived among us, and we have seen his glory, the glory as of a father’s only son,* full of grace and truth. 15(John testified to him and cried out, ‘This was he of whom I said, “He who comes after me ranks ahead of me because he was before me.” ’) 16From his fullness we have all received, grace upon grace. 17The law indeed was given through Moses; grace and truth came through Jesus Christ. 18No one has ever seen God. It is God the only Son,* who is close to the Father’s heart,* who has made him known.

So we ask ourselves, what exactly does the Qur’an have to say about John, and going to Wikipedia, I found the following (I have added paragraph separations to make it more readable):
According to the Qur’an
According to the Quran, Yahya was the son of Zakariya, and was foretold to his father by the angel Gabriel. Yahya is called a righteous, honorable and chaste person, as well as a Prophet of the Righteous ([Qur’an 6:85], [Qur’an 3:39]). He came to confirm the Word of God ([Qur’an 3:39]). His story was retold by Jafar to the Abyssinian King during the Migration to Abyssinia [2].
In his recent article, Agron Belica say’s the following: this prophet has been overlooked and misrepresented. One reason he has been overlooked is because there are five words used in the Quran to describe Prophet Yahya that have been misinterpreted in translations of the Quran. The first is the word hasur which is usually translated “chaste.” My research shows that the Arabic word hasur does not mean “chaste” with regard to Yahya; rather , it means “a concealer of secrets.”
Why the mistake in translation and commentary? As there was no extensive information given in the Quran about the life of Prophet Yahya nor in the hadith, the commentators then turned to Christian tradition and simply repeated what they found there. Nonetheless, the commentators of the Quran have placed considerable emphasis on this word.
Al-Tabari interprets the word hasur to mean one who abstains from sexual intercourse with women. He then reports a hadith on the authority of Said ibn al-Musayyab which has Prophet Muhammad saying the following: “Everyone of the sons of Adam shall come on the Day of Resurrection with a sin (of sexual impropriety) except Yahya bin Zechariah.’ Then, picking up a tiny straw, he continued, ‘this is because his generative organ was no bigger then this straw (implying that he was impotent).’” Does this mean that even the prophets outside of Yahya will be raised up with this sin of sexual impropriety? How can we accept that this was said by such a modest human being, comparing a straw to another prophet’s generative organ? Was Yahya impotent?
One commentator, Ibn Kathir, a renowned Islamic scholar , rejects this view and adds, “This would be a defect and a blemish unworthy of prophets.” He then mentions that it was not that he had no sexual relations with women, but that he had no illegal sexual relations with them. Indeed, the whole discussion is unseemly. It is known that prophets of God are immune from major sins, so this statement makes no sense at all when interpreting the word, hasur. In addition, I would like to mention the fact that in his commentary, ibn Kathir says he (Yahya) probably married and had children. He said this on the basis of what was related in the Quran of the prayer of Zachariah. There are at least three reasons why interpreting hasur in this context as “chaste” is a misinterpretation: First of all, there is another word in the Quran for “chaste” and that is muhasanah. As God used a different word with hasur, it must mean something different. Secondly, God says in the Quran that Islam did not bring monasticism but that it was something that they (the Christians) invented. Therefore, God would not have sent a Prophet who was celibate. In addition, it is contrary the exhortation in the Torah to “go forth and multiply.” Thirdly, Yahya’s father, Zechariah prayed for a protector who would provide descendants (dhuriyyat) for his family. “There Zachariah called to his Lord; he said: My Lord! Bestow on me good offspring from Thy presence; truly Thou art hearing supplication.” (3:38) God gave him Yahya.
God would not have sent a son to Zechariah who would not carry on the line of Jacob’s descendants because then God would not have answered the prayer of Zechariah. The word hasur is used only one time in the Quran and that is in regard to the Prophet Yahya.
A major Arabic-English lexicon, that of Edward William Lane (Taj al-Arus) states that when hasur is used alone, it means “concealer of secrets.” In his translation, of Ibn al- Arabi’s Book of the Fabulous Gryphon, Elmore also translates the Arabic hasur “as consealer of secrets.” In the referenced passage, “chaste” would not have been appropriate. (Gerald T. Elmore, Islamic Sainthood in the Fullness of Time, Brill 1999, P. 482)
The second word that has been misinterpreted is waliy (19:5) which in this verse and many others in the Quran means “protector” not “heir or successor.” In this specific case, Zechariah prays to his Lord: “And truly I have feared my defenders after me and my wife has been a barren woman. So bestow on me from that which proceeds from Thy Presence a protector (waliy).”
The third word that is misinterpreted is that of fard in (21:89): “And mention Zechariah when he cried out to his Lord: My Lord! Forsake me not unassisted (fard) and Thou art the Best of the ones who inherit.” It is usually translated as “heir,” but the same reasoning applies as above. The word “unassisted” refers to the fact that Zechariah did not want to be left alone without any protector. He feared for those who would defend him and his honor after he died, that they would be left without a protector and thereby could not defend his honor.
The fourth misinterpreted word in relation to Prophet Yahya is sayyid. Prophet Yahya is referred to as a sayyid, chief in the Quran. The commentators have interpreted this to mean that he was a scholar of religious law, a wise man, a noble wise and pious man, and so forth. This was a prophet of God. Knowledge and wisdom were given to him by his Lord. The title given to Yahya by his Lord shows that Prophet Yahya is one who has authority over his people and not “noble” or “honorable” as this word is usually translated. Honor and nobility are good qualities but they fail to indicate that Prophet Yahya is given a role of leadership by his Lord.
The fifth word is hanan which means “mercy,” which is part of the compound name Yu’hanan (in English “John”), meaning “God is Merciful.” The word hanan is used once in the Quran and that is in reference to Prophet Yahya: “And continuous mercy from Us and purity . . . .” This is singularly appropriate to the circumstances of the Prophet Yahya. The names Yahya and Yuhanan are not the same as many assume. They have two entirely different roots. Hanan and hanna both derive from the Semitic root h n n. While the word hanna means “mercy or tenderness,” the root word for Yahya is h y y. It means “life” or “he lives.” One does not need to be a linguist to see the obvious. In addition, I would like also to mention that this name and attribute given to Prophet Yahya can also be found in Sabean literature. The Sabians are mentioned in the Quran in verses (2:62), (5:69) and (22:17).
In their canonical prayer book we find Yahya Yuhanna. It has been known that it is the practice of the Sabians to have two names, a real name and a special name. According to the Sabians, this prophet’s real name was Yahya (he lives) and his lay name was Yuhanna (John). Prophet Yahya is the only one given this name as the Quran clearly states: “O Zechariah! Truly We give thee the good tidings of a boy; his name will be Yahya (he who lives) and We assign it not as a namesake (samiyya) for anyone before.” Again, another word that we need to pay attention to is samiya. It is used twice in the Quran, once in reference to Yahya (19:7) “O Zechariah! Truly We give thee the good tidings of a boy; his name will be Yahya and We assign it not as a namesake (samiya) for anyone before.” The other time it is used is in reference to God. “. . . Knowest thou any namesake (samiya) for Him [God]?” (19:65)
In the famous Arabic lexicon Lisan al-arab the root word s m w means elevation or highness. “Then the angels proclaimed to him while he was in the sanctuary that God gives you good tidings of Yahya-one who establishes the word of God as true- a chief and a concealer of secrets and a prophet, among the ones who are in accord with morality.”(3:39) See The Sublime Quran Pocket Size translated by Laleh Bakhtiar (2009)
So here is what I am thinking this morning . . . We have so much to offer one another. We use each other’s books – Jewish, Christian, Moslem – and studies to illuminate our beliefs. Why are we niggling over trivialities? If we were to clasp hands and fight together against the forces of darkness, what a mighty force for good we would be!
Don’t Mess with Seniors!
A while back, one of my commenters said she had read a book with an “old” couple just like AdventureMan and me.
“Old??” we looked at each other in horror!
“Old people with a son getting married” is I think what she said, so that makes just about every person over 45 “old.”
We will have our revenge. Time flows only in one direction – but the older you get, the farther away “old” looks.
My 85 year old mother visits friends, now and then, who live in retirement homes, from modest to posh.
“What do you think, Mom?” we ask, knowing how lonely she is without Dad and wishing she had more companions around her to do things.
She sighs.
“They are all so OLD!” she says. “I don’t want to be surrounded by all old people!”
And she is right. She lives on her own, she cooks her own meals, cleans her own home, with only a little help from a cleaning lady and her family. She keeps herself in good shape. She is far from “old.”
I found this in today’s news on AOL – some young idiots thought they had an easy target. They thought wrong.

Two would-be carjackers learned the hard way not to mess with this grandfather. Ted Mazetier, 84, stopped to help two men with a broken-down car in Tacoma, Wash., April 22 but ended up fighting them off when they attacked and demanded his keys. Mazetier kicked one in the groin and the other in the stomach. The two were later arrested, KOMOnews.com reported.
Who Is My Neighbor?
You would think when someone so special is talking, people would listen. You would think that when he is trying to tell us what God expects from us to enter into his kingdom in the after life, people would be listening, and indeed, they listened, many listened. There were others who did not. There were also those closest to him who misunderstood! That always baffles me, that those closest could misunderstand.
Today’s lesson is one of my very favorites in the world. You can substitute any two races who hate one another and the story is equally clear. The man who was asking the question was setting Jesus up, or trying to, and Jesus used the occasion to teach a stunning truth – that love is stronger than hate.
Luke 10:25-37
25 Just then a lawyer stood up to test Jesus.* ‘Teacher,’ he said, ‘what must I do to inherit eternal life?’
26He said to him, ‘What is written in the law? What do you read there?’
27He answered, ‘You shall love the Lord your God with all your heart, and with all your soul, and with all your strength, and with all your mind; and your neighbour as yourself.’
28And he said to him, ‘You have given the right answer; do this, and you will live.’
29 But wanting to justify himself, he asked Jesus, ‘And who is my neighbour?’
30Jesus replied, ‘A man was going down from Jerusalem to Jericho, and fell into the hands of robbers, who stripped him, beat him, and went away, leaving him half dead. 31 Now by chance a priest was going down that road; and when he saw him, he passed by on the other side. 32 So likewise a Levite, when he came to the place and saw him, passed by on the other side. 33 But a Samaritan while travelling came near him; and when he saw him, he was moved with pity. 34 He went to him and bandaged his wounds, having poured oil and wine on them. Then he put him on his own animal, brought him to an inn, and took care of him. 35 The next day he took out two denarii,* gave them to the innkeeper, and said, “Take care of him; and when I come back, I will repay you whatever more you spend.” 36 Which of these three, do you think, was a neighbour to the man who fell into the hands of the robbers?’

I have seen this in my own life. I have seen hopeless situations, with no solution in sight, totally change because one person chooses to love, instead of to hate. Choosing to love, in the face of hatred, takes a lot more character, a lot more strength. It has the potential for changing everything.
Alexander McCall Smith: Tea Time for the Traditionally Built
This brand new book in the No. 1 Ladies’ Detective Agency series could not have come at a better time for me. Sorting through, giving away, selling my car – it all takes a toll. It’s a little like dying, this moving. I know I will be “resurrected” in another life, but in the meanwhile, I have so much grief, and I just stuff it away and keep going. These books are my carrots; they are my reward at the end of the day.

I have a stack of books and I am going through them like a locomotive – just chugging along.
Mma Precious Ramotswe and her totally different world in Botswana sweep me away totally. I love the sweetness of the way she thinks, her love for her country, and her tolerance. In Tea Time for the Traditionally Built, several things are going on at once, not the least of which is that she, also, must part with her dearly loved little white van, which has gone as far as it can go, and can go no further. The engine cannot be revived, not even one more time, by her dear husband, mechanic J.L.B. Matekoni.
Just in time, just when they need a new customer, comes Mr. Molofololo, the owner and manager of the Kalahari Swoopers, who hires Mma Ramotswe to find the traitor who is causing the Swoopers to lose their games.
Last, but not least, Mma Makutsi’s fiancee (she is the Assistant Detective now, remember?) Phuti Radiphuti, is being assaulted by Makutsi’s old rival from the secretarial school, Violet Sephotho, who is looking for a rich husband, and would love to steal Grace’s fiancee away, for all the worst reasons. How can plain Grace, with her big glasses and her unfortunate complexion, compete with the glamorous and seductive Violet? Can Phuti resist her wiles?
When I reached the last ten pages of the book, none of these crises had been resolved, and I thought “Oh no! How can the book end with all these loose ends out there?” but in a deft drawing together, McCall vanquishes the devils, finds simple solutions, and leaves us with Mma Ramotswe and Mma Makutsi having tea together at the President Hotel.
This book is a great way to end the day with a smile on your face. 🙂 I bought this book for $21 in a bookstore, but Amazon has it for $14.37 plus shipping. I don’t buy a lot of hardcover books, but this one was worth every penny.
Sorry Jesus, I’m Packing Boxes
Our priest in the Anglican congregation is a truly inspired preacher. He knows how to get your attention, and then he tells you something really important.
Yesterday (Yes! I was listening!) he was talking about the importance in our spiritual life of community. While, in Christianity, we have a tradition of worshiping privately and in solitude, one of the things Jesus said over and over was to take care of one another, “feed my sheep”, that we are to be known to the outside world by the way we love one another, and the practice of that kind of brotherly love must be done in community. He gave one example, marriage, as an opportunity to show God how much you love him by loving and taking good care of your spouse, that we are to serve him by loving one another.
Pastor Andy gave the example of the Alcoholics Anonymous community, where they have buddies who can be called any time, night or day, when a crisis comes up and there is temptation to drink. He was saying we all need someone we know we can count on, and encouraged us to find spiritual buddies.
On the way out the door, I heard him ask the guy in front of me if he had plans for lunch. When we shook hands, he asked me the same question, and I laughed and said “Yes, I am packing boxes.”
As I was on my way home, it was like that old light bulb went on in my head and I thought “Oh no! That was a test!” Andy was just telling us we need to be part of a fellowship, we need to visit with one another in relaxed conditions, we need to know one another so we know who we can count on! It was as if Jesus invited me to lunch, and I said ‘Sorry, I have to pack boxes!’
I FLUNKED!
So I started beating myself up (in my mind) about flunking. The good thing is, as you pack boxes, it’s kind of like exercise, once you have two or three done, good endorphins kick in and you feel better about things. Eating lunch helps, too.

Eliot Pattison: Prayer of the Dragon
As you can see, I am into some serious reading. Not heavy reading, but books like carrots – I am the donkey, plodding way, packing my boxes, sorting, weeding, throwing out – it is time consuming, and it is pitiless work. I need the promise of a great excape at the end of my day to keep me going.
Prayer of the Dragon was a GREAT carrot. I like all of Eliot Pattison’s Inspector Shan Tao Yun series, set in Tibet. In his very first book, we meet Shan as he is still in the Tibetan prison camp, imprisoned for exposing corrupt officials in China. He learns a huge appreciation, in prison, for a different way of thinking, and his treasured companions become the Bhuddist monks with whom he is imprisoned. If you want to read this series, you can read any book as a stand-alone, but it helps to read them in order, starting with The Skull Mantra. The Chinese eventually free Shan; they find him useful – as long as he is not exposing corruption in the Chinese bureaucracy. He is free on parole; he lives with the sword over his head. At any time, if he crosses an important person, he can be sent back to the merciless gulag.

In The Prayer of the Dragon Inspector Shan finds himself involved in a series of murders on the mountainside, in a small mining village. The village headman has a great scam going, skimming the miners take, charging passage on the mountain trails, and keeping his village hidden from the Chinese bureaucracy.
Here is what I learned that surprised me. There appears to be a connection between the American Navaho nation and the native Tibetans. They share some body-prototype similarities, and they share many symbols and earliest legends. An first-nation Navaho and his niece are exploring similarities, and commonalities, when two members of their party are murdered while sleeping. The Navaho is charged, by the headman, with the death, because he survived although he is covered in blood. It doesn’t make sense, but it doesn’t have to. The headman needs a scapegoat, and he chooses the Navaho.
It is a fascinating read. Here is an excerpt from a conversation Inspector Shan has with the local director of Public Security:
“I know your type so well, Shan, ” Bing said. “God, how well I know you. I was responsible for ten barracks of prisoners, like you – pathetic, morose creatures with no vision, only bitterness about the past. They would sit in reeducation classes and copy out slogans from the little red books like robots, praising the Chairman, reading aloud apologies printed in other books, using someone else’s words. Never a one among them with the balls to stand up and say Fuck the Chairman, screw the Party secretaries, and screw the limo drivers who brought them to town.”
“I tried at first,” Shan replied in a weary voice. “They sent me to a special hospital for the criminally insane.”
“Unfortunately,” Bing said soberly, “you are the sanest person I have ever met.”
AdventureMan knows I love these books. “Do you want to go to Tibet?” he asks me, and I say “No, if I went I would want to hang around with Inspector Shan and his gang of monks, not do tourist things allowed by the Chinese.” These are great reads, Pattison is doing a great job of bringing the plight of the Tibetans to the conscience of his readers, depicting, in graphic, horrorific detail how the Chinese are systematically crushing and obliterating every shred of Tibetan culture, while claiming they are not. I think one of the very worst things they have done is taking over the Tibetan monastery system and corrupting it into something it was never meant to be, a cruel, ugly deformity.
I can hardly wait for the next book to come out. I am on the waiting list for The Lord of Death, yet another book about Chinese bureaucratic corruption and the adventures Inspector Shan has in Tibet confronting and evading all its manifestations.
Susan Wittig Albert: Nightshade
In her ongoing China Bayles mystery series, China and her husband investigate the death of China’s father, with some amazing outcomes.
These are not heavy reading. This series features a burned-out criminal defense lawyer, who, sick of the slime and the jockying for power and position, cashes in her retirement plans and buys a shop in the small fictional town of Pecan Springs, Texas, where she opens an herbal shop, Thyme and Seasons, which sells live potted herbs, but also herbal wreaths, herbal soaps, herbal bath bombs, herbal teas, herbal shampoos, etc – and shares space with a new age shop called The Crystal Cave, a tea shop called Thyme for Tea, a catering company called Party Thyme and a personal chef service called Thymely Gourmet. She and her girlfriends have a lot of fun.
And, somehow, even in this idyllic life, mysteries seek out China, and she is often involved in crime-solving outside of her normal business. This time, her brother – the brother she never knew she had, the brother her father had with his secretary while China was growing up, wondering where her father was all the time – is murdered, in what appears to be a hit-and-run accident, but is no accident at all. Her brother was trying to get China involved with finding out how and why their father died – another apparent accident, which was no accident. When China isn’t interested (she is still very angry with her dad for what she perceives as a betrayal of her and her mother), her brother hires China’s husband as a private detective to examine the evidence. Then – her brother is killed. China gets involved.
It’s great escape reading, but you often end up learning something, too. China is an idealist, fighting crime and corruption, and God knows, there is enough of that, all the world around, to keep a legion of fictional crime fighters busy.
“After I grew up and joined the Houston legal fraternity, I began to understand what was common knowledge in that gossip-driven oil company town: Robert Bayles and his partner Ted Stone had built their legal practice on dubious oil and energy deals, questionable land transactions, and political dirty work. Their clients included polluters, looters and influence peddlers. Both Ted Stone and my father were frequent guests of the Suite 8F crowd, the group of influential conservatives who met on the eighth floor of Houston’s Lamar Hotel and collectively decided who was going to run for what political office, at the state level and beyond. To ensure that their picks – LBJ had been one of them – made it to the winner’s circle, Suite 8F slipped wads of campaign cash into the necessary pockets. Their contributions decided which politicians moved into positions of power and influence.
Just as important, their money brought them preferential treatment when the bidding opened on lucrative government contracts for dams, ships and shipyards, oil pipelines, military bases at home and abroad, NASA’s Johnson Space Center in Houston. The Lamar Hotel was demolished in 1983 to make room for a skyscraper, but the political influence of 8F lingers like a foul odor, a dirty fog. It’s the subject of books, of doctoral dissertations, of documentaries. It’s common knowledge.”

Reading Albert is a great escape. Even knowing that sweet little Pecan Springs is a microcosm of the rest of the world, not untouched by human frailty, it is a sweet place with a culture all its own. China’s life, surrounded by her loving husband, her stepson, all their pets, their friends, the places they eat, it’s all comfortable, an herbal scented different world.
Living our Religion
Today’s reflection from Forward Day by Day is a tough one. In the Gulf, there is a tradition of thfadl and thfadli (the second is what you say to a woman) which means, literally, “you are to be preferred.” You are supposed to outwait the other, to allow the other to take precedence.
I have one Kuwaiti friend – you know who you are – who simply cannot be out-thfadle-d. She out-thfadle-s me every time. 🙂
But when I read this passage, and think of how I live in Kuwait, I find myself thinking “Guilty! Guilty as charged!”
When I see a long line in front of me at the health department, and someone comes and ushers me to the front, yes, I have gratefully taken advantage, taken preference over those who continue to wait. I have scowled when people try to shove their basket in front of me in the supermarket. And in traffic – when I “thfadl”, it has nothing to do with politeness and preference, and everything to do with sarcasm and frustration.
Today’s reading reminds me I still have a long road in front of me when it comes to learning to love my neighbor, and put others first.
Romans 12:1-21. Outdo one another in showing honor.
The Episcopal Church (and some other denominations, too) is vexed these days by rancorous disputes about authority and sex. Name-calling, smirking, and thinly veiled anger sometimes characterize church gatherings. The prevailing sentiment seems to be that we ourselves are faithful and true, but those others are faithless and false. We demean and dismiss other Christians. It’s hard to find a Christian today who outdoes others in showing honor (except honor shown to those lined up on one’s own side). Is it any wonder that many people outside the church want nothing to do with us?
I long for the day when we will approach those who differ from us and say: “I agree with almost nothing you are advocating. I see God, the world, and our faith through different lenses than you do. But I know that God loves us both and has sent his Son to forgive and redeem us both. I know that Christ lives within us both. Therefore I honor you and join you in prayer and in worshiping our common Lord. I shall remain silent today so that you may speak and I may learn from you. I thank God for you because I see Jesus when I look at you.”
Wives, be subject to your husbands
This part of today’s reading, among my set and the things we discuss, is one of the most controversial. We can debate this for hours.
What does being subject mean? If we, as wives, are subject to our husband, just as our husbands are subject to God, does it mean we can’t argue? We can’t disagree?
I saw a husband say to a wife the other day “I forbid you.” I think this is more common in Gulf culture than in our culture. I am sorry, but the thought of a husband daring to say this to a wife in the west is unthinkable. What I have also noticed is that when a husband says “I forbid you” here, it is not the end, but the opening skirmish. 🙂

Somali Pirate Code of Conduct
Ever since I was a kid, I found pirates interesting and exotic and adventurous. The truth is probably that those olden day pirates had bad teeth, scurvey – they had lived hard and fast and they probably aged quickly.
Of course, today we have Johnie Depp and the Pirates of the Caribbean series, which makes pirating look mostly like a lot of fun.
So a year or so ago, I wrote a post on the Somali pirates, and got an interesting response. It got me started looking more deeply into what is going on with the pirates there.

Yesterday, in the paper was an article about the Somali pirate code of conduct – with fines and punishments for infractions. I found a complete article in Newsweek, April 27.
What is bothering me now is that the one pirate captured by the US when it retook the captured US freighter (in the report filed by one BBC reporter) said he was just a frail teenager, a kid, and that the pirates had already agreed to surrender when they were blown out of the water. You could hear her attempting to control her rage.
I know it is a thorn in the side for all shippers and freighters and passenger ships who travel through waters anywhere near to Somalia. And yet . . . I kind of ask myself what the options are? Somalia is a for sure failed-nation. They haven’t been able to cobble together a government for over twenty years. Deadly, long lasting poisons have been dumped along their shoreline – and major industrial nations paid Somalis a pittance to dump their wastes there. Their coastline has been overfished. Families are starving, live is – or was – dismal.
I think it is pretty cool that they developed an enforceable – and enforced – code of conduct.

It was a hit with the U.S. public, but president Obama’s decision to authorize the Pentagon to kill three Somali pirates who took an American sea captain hostage sent shudders through the world’s shipping and insurance industries. Because the pirates are motivated chiefly by money, maritime experts say, they have—at least until now—taken good care of the crews they hold captive. A document retrieved from a ship hijacked last year contained a “list of written rules” of conduct pirates had to follow, according to a maritime security expert who requested anonymity when discussing sensitive material. The document included a series of “punishments” to be imposed on any hijacker who struck a hostage.
Shipping companies and insurers are far more likely to fork over large ransoms if they have confidence that their personnel and cargo will be released unharmed, and while the scourge of piracy has been disruptive, so far there have been virtually no casualties among innocent people. According to estimates, there were 111 pirate attacks off the Somali coast in 2008; 42 were successful, resulting in the capture of 815 seamen. As of last week, according to one estimate, all but 37 had been released, and two had died—one reportedly of illness. Experts say the rate of attacks has increased sharply this year, and “the more [authorities] shoot, the more the pirates will shoot back,” says Tom Wilson, a Somalia analyst for the British consulting firm Control Risks.
Protecting the 23,000 merchant vessels sailing annually near the Horn of Africa would require a naval fleet of at least 60 ships, according to U.S. government and private experts; the existing international antipiracy task force has about 20. And attacking the Somali coastal villages where the pirates are based could potentially radicalize generations of Somalis. “That would be a 19th-century solution,” says Neil Roberts, a marine insurance expert with Lloyd’s Market Association in London. Industry experts say the only solution to piracy is the creation of a viable Somali government back on dry land.
According to industry officials, ransom demands have ranged as high as $25 million—but in most cases they are negotiated down to about $2 million to $3 million, and insurers then pay out claims to the shipping companies. As hijackings have increased in frequency, pirates have become fussier about how their money gets delivered. Initially, said a shipping-industry source who also asked for anonymity, ransoms were often handed off to shady Somali expats in places like Kenya. After Kenyan authorities cracked down, the pirates began insisting on airdrops via parachute into the ocean near Somali coastal villages, where they have cash-counting machines ready. Until the U.S. opened fire, one of the pirates’ biggest headaches had been dealing with the sheer volume of money they’ve collected. Last year, according to an insurance-industry official, one pirate’s boat capsized because he had overloaded it with cash.

MOGADISHU — A mobile tribunal, a system of fines and a code of conduct: the success of Somali pirates’ seajacking business relies on a structure that makes them one of the country’s best-organised armed forces.
A far cry from the image conveyed in films and novels of pirates as unruly swashbucklers, Somalia’s modern-day buccaneers form a paramilitary brotherhood in which a strict and complex system of rules and punishments is enforced.
They are organized in a multitude of small cells dotting the Indian Ocean and Gulf of Aden coastline. The two main land bases are the towns of Eyl, in the breakaway state of Puntland, and Harardhere, further south in Somalia.
“There are hundreds of small cells, linked to each other,” Hasan Shukri, a pirate based in Haradhere, told AFP in a phone interview.
“We talk every morning, exchange information on what is happening at sea and if there has been a hijacking, we make onshore preparations to send out reinforcement and escort the captured ship closer to the coast,” he explained.
Somali piracy started off two decades ago with a more noble goal of deterring illegal fishing, protecting the people’s resources and the nation’s sovereignty at a time when the state was collapsing.
While today’s pirates have morphed into a sophisticated criminal ring with international ramifications, they have been careful to retain as much popular prestige as possible and refrain from the violent methods of the warlords who made Somalia a by-word for lawlessness in the 1990s.
“I have never seen gangs that have rules like these. They avoid many of the things that are all too common with other militias,” said Mohamed Sheikh Issa, an elder in the Eyl region.
“They don’t rape, and they don’t rob the hostages and they don’t kill them. They just wait for the ransom and always try to do it peacefully,” he said.
Somalia’s complex system of clan justice is often rendered obsolete by the armed chaos that has prevailed in the country for two decades, but the pirates have adapted it effectively.
Abdi Garad, an Eyl-based commander who was involved in recent attacks on U.S. ships, explained that the pirates have a mountain hide-out where leaders can confer and where internal differences can be solved.
“We have an impregnable stronghold and when there is a disagreement among us, all the pirate bosses gather there,” he told AFP.
The secretive pirate retreat is a place called Bedey, a few miles from Eyl.
“We have a kind of mobile court that is based in Bedey. Any pirate who commits a crime is charged and punished quickly because we have no jails to detain them,” Mr. Garad said.
Some groups representing different clans farther south in the villages of Hobyo and Haradhere would disagree with Mr. Garad’s claim that Somalia’s pirates all answer to a single authority.
But while differences remain among various groups, the pirates’ first set of rules is precisely aimed at neutralizing rivalries, Mohamed Hidig Dhegey, a pirate from Puntland, explained.
“If any one of us shoots and kills another, he will automatically be executed and his body thrown to the sharks,” he said from the town of Garowe.
“If a pirate injures another, he is immediately discharged and the network is instructed to isolate him. If one aims a gun at another, he loses 5% of his share of the ransom,” Mr. Dhegey said.
Perhaps the most striking disciplinary feature of Somali “piratehood” is the alleged code of conduct pertaining to the treatment of captured crews.
“Anybody who is caught engaging in robbery on the ship will be punished and banished for weeks. Anyone shooting a hostage will immediately be shot,” said Ahmed Ilkacase.
“I was once caught taking a wallet from a hostage. I had to give it back and then 25,000 dollars were removed from my share of the ransom,” he said.
Following the release of the French yacht Le Ponant in April 2008, investigators found a copy of a “good conduct guide” on the deck which forbade sexual assault on women hostages.
As Ilkacase found out for himself, pirates breaking internal rules are punished. Conversely, those displaying the most bravery are rewarded with a bigger share of the ransom, called “saami sare” in Somali.
“The first pirate to board a hijacked ship is entitled to a luxurious car, or a house or a wife. He can also decide to take his bonus share in cash,” he explained.
Foreign military commanders leading the growing fleet of anti-piracy naval missions plying the region in a bid to protect one of the world’s busiest trade routes acknowledge that pirates are very organised.
“They are very well organized, have good communication systems and rules of engagement,” said Vice Admiral Gerard Valin, commander of the French joint forces in the Indian Ocean.
So far, nothing suggests that pirates are motivated by anything other than money and it is unclear whether the only hostage to have died during a hijacking was killed by pirates or the French commandos who freed his ship.
Some acts of mistreatment have been reported during the more than 60 hijackings recorded since the start of 2008, but pirates have generally spared their hostages to focus on speedy ransom negotiations.
With the Robin Hood element of piracy already largely obsolete, observers say the “gentleman kidnapper” spirit could also fast taper off as pirates start to prioritize riskier, high-value targets and face increasingly robust action from navies with enhanced legal elbow room.
They have warned that the much-bandied heroics of a U.S. crew who wrested back control of their ship and had their captain rescued by navy snipers who picked off three pirates could go down as the day pirates decided to leave their manners at home.
I used to read science fiction novels about a diplomat named Retief, I think they were by Keith Laumer. He would find himself in an alien environment with a horrible unsolvable problem and he would find a great solution, where everyone walked away OK. I wish there were a Retief who could negotiate a win/win out of this situation.
