Sudanese woman may face death for choosing Christianity over Islam

KHARTOUM: A Sudanese court gave a 27- year-old woman until today to abandon her newly adopted Christian faith and return to Islam or face a death sentence, judicial sources said on Monday. Mariam Yahya Ibrahim was charged with apostasy as well as adultery for marrying a Christian man, something prohibited for Muslim women to do and which makes the marriage void. The final ruling will be announced today.

Ibrahim’s case was the first of its kind to be heard in Sudan. Young Sudanese university students have mounted a series of protests near Khartoum University in recent weeks asking for an end to human rights abuses, more freedoms and better social and economic conditions.

The authorities decided on Sunday to close the university indefinitely. Western embassies and Sudanese activists sharply condemned the accusations and called on the Sudanese Islamist-led government to respect freedom of faith. “The details of this case expose the regime’s blatant interference in the personal life of Sudanese citizens,” Sudan Change Now Movement, a youth group, said in a statement.

President Omar Hassan Al-Bashir’s government is facing a huge economic and political challenge after the 2011 secession of South Sudan, which was Sudan’s main source of oil. A decision by Bashir last year to cut subsidies and impose austerity measures prompted violent protests in which dozens were killed and hundreds were injured. — Reuters

Nigeria’s Stolen Girls

This is what I love about New Yorker magazine: they print stories no one prints, they follow stories that need following. They lead, and they do their job, alerting us to issues that matter. My heart goes out to the families, Christian and Muslim, of these girls who were abducted because they were being educated. Boko Haram believes educating women goes against Islam. Someone should read them a Quran.

NIGERIA’S STOLEN GIRLS

AP218361876356-580.jpg“I thought it was the end of my life,” Deborah Sanya told me by phone on Monday from Chibok, a tiny town of farmers in northeastern Nigeria. “There were many, many of them.” Boko Haram, an Islamist terrorist group, kidnapped Sanya and at least two hundred of her classmates from a girls’ secondary school in Chibok more than two weeks ago. Sanya, along with two friends, escaped. So did forty others. The rest have vanished, and their families have not heard any word of them since.

Sanya is eighteen years old and was taking her final exams before graduation. Many of the schools in towns around Chibok, in the state of Borno, had been shuttered. Boko Haram attacks at other schools—like a recent massacre of fifty-nine schoolboys in neighboring Yobe state—had prompted the mass closure. But local education officials decided to briefly reopen the Chibok school for exams. On the night of the abduction, militants showed up at the boarding school dressed in Nigerian military uniforms. They told the girls that they were there to take them to safety. “They said, ‘Don’t worry. Nothing will happen to you,’ ” Sanya told me. The men took food and other supplies from the school and then set the building on fire. They herded the girls into trucks and onto motorcycles. At first, the girls, while alarmed and nervous, believed that they were in safe hands. When the men started shooting their guns into the air and shouting “Allahu Akbar,” Sanya told me, she realized that the men were not who they said they were. She started begging God for help; she watched several girls jump out of the truck that they were in.

It was noon when her group reached the terrorists’ camp. She had been taken not far from Chibok, a couple of remote villages away in the bush. The militants forced her classmates to cook; Sanya couldn’t eat. Two hours later, she pulled two friends close and told them that they should run. One of them hesitated, and said that they should wait to escape at night. Sanya insisted, and they fled behind some trees. The guards spotted them and called out for them to return, but the girls kept running. They reached a village late at night, slept at a friendly stranger’s home, and, the next day, called their families.

Sanya could not tell me more after that. She is not well. Her cousins and her close friends are still missing, and she is trying to understand how she is alive and back home. All she can do now, she said, is pray and fast, then pray and fast again.

The day after the abduction, the Nigerian military claimed that it had rescued nearly all of the girls. A day later, the military retracted its claim; it had not actually rescued any of the girls. And the number that the government said was missing, just over a hundred, was less than half the number that parents and school officials counted: according to their tally, two hundred and thirty-four girls were taken.

In the wake of the military’s failure, parents banded together and raised money to send several of their number into the forest to search for the girls. The group came across villagers who persuaded the parents to turn back. They told the parents that they had seen the girls nearby, but the insurgents were too well armed. Many of the parents had just bows and arrows.

The circumstances of the kidnapping, and the military’s deception, especially, have exposed a deeply troubling aspect of Nigeria’s leadership: when it comes to Boko Haram, the government cannot be trusted. Children have been killed, along with their families, in numerous Boko Haram bombings and massacres over the past five years. (More than fifteen hundred people have been killed so far this year.) State schools and remote villages in the north have borne the brunt of Boko Haram’s violence this year. The group is believed to be at least partly waging a campaign against secular values. The kidnapped girls were both Christian and Muslim; their only offense, it seems, was attending school.

Last June, I visited Maiduguri, the capital of Borno state and the birthplace of Boko Haram, to report on the insurgency and the Nigerian government’s counteroffensive, a security operation that placed three northeastern states, including Borno and Yobe, under a state of emergency as troops launched attacks on terrorist hideouts and camps. The military cut phone lines and Internet access, and, while residents were glad for the intervention, there was a sense of living in the dark. Gunshots, a bomb blast: was it Boko Haram or a military attack? Were the hundreds of men disappeared by the military actually terrorists—even the young boys? And was the government, as it claimed, really winning the war?

The military has restored phone lines in Borno. But the sole airline that flew to Maiduguri cancelled the route at the end of last year. The road to Chibok is so hazardous that Borno’s governor visited the town with a heavy military escort. Much of the northeast is now physically isolated. What is happening there that we cannot see?

Nigerians in the rest of the country had, until recently, been able to ignore the deaths. The general mood has been one of weary apathy—from a government waging a heavy-handed crackdown on northerners to civilians far removed from the chaos. That mood may finally change.

Sanya’s father, a primary-school teacher named Ishaya Sanya, is struggling with conflicting emotions: gratitude that his daughter has returned to him; guilt that the daughters of his siblings, friends, and neighbors are still somewhere in the bush; and an angry frustration that there seemed to be no effort to rescue the girls.

“We don’t know where they are up until now, and we have not heard anything from the government,” he told me. “Every house in Chibok has been affected by the kidnapping.” The only information that the families had been able to gather about the kidnapped girls, he went on, was from the girls who had escaped.

He remembers the exact time that Deborah appeared in front of him after her escape—4:30P.M.—and how he felt: “very happy.” But his despair soon returned. “Our area has been affected very seriously,” he told me. Parents had fallen physically ill, and some were “going mad.”

The military’s current plans are unclear; the Chibok parents hope that it is acting swiftly and cautiously. There is worry, too, that a rescue operation could result in the deaths of many of the girls; this happened during a previous attempted rescue, of two Western engineers kidnapped by Boko Haram. Last week, a military spokesman, Brigadier-General Chris Olukolade, said only that the search for the girls had “intensified.”

In the meantime, as in so many other ways in Nigeria, each community has to fend for itself. For a while after the abduction, girls trickled back into town—some rolled off trucks, some snuck away while fetching water. That trickle has stopped. “Nobody rescued them,” a government official in Chibok said of the girls who made it back. “I want you to stress this point. Nobody rescued them. They escaped on their accord. This is painful.”

A pastor in Chibok whose daughter is missing told me that he set out with friends on the morning after the abduction to find the girls. “I was forced to come home empty-handed,” he told me by phone. “I just don’t know what the federal government is doing about it. And there is no security here that will defend us. You have to do what you can do to escape for your life.”

I asked the pastor about rumors that Boko Haram has taken the girls outside of Nigeria’s borders, into Cameroon and Chad, and forcibly married them. He paused, and then said, “How will I be happy? How will I be happy?”

Women

Rape and Domestic Violence: Violence against women continued to be a problem. Rape carries a maximum penalty of death, which the country occasionally imposed for the crime; spousal rape is not a crime. The media reported hundreds of rape cases, but government statistics indicated that only 34 cases were reported to the police. Social stigma associated with publicly acknowledging rape likely resulted in underreporting. Many victims were noncitizen domestic workers. Police occasionally arrested alleged rapists. The courts tried and convicted three rapists during the year, but authorities did not effectively enforce laws against rape, especially in cases of noncitizen women raped by their employers.

The law does not specifically prohibit domestic violence, but courts try such cases as assault. A victim of domestic violence may file a complaint with police requesting formal charges be brought against the alleged abuser. Each of the country’s 83 police stations reportedly received complaints of domestic abuse. Victims, however, did not report most domestic abuse cases, especially outside the capital. Police officials rarely arrested perpetrators of domestic violence even when presented with documented evidence of the abuse, such as eyewitness accounts, hospital reports, and social worker testimony, and treated such reports as social instead of criminal matters. Individuals also reportedly bribed police officials to ignore assault charges in cases of domestic abuse. Although courts found husbands guilty of spousal abuse in previous years, those convicted rarely faced severe penalties. Noncitizen women married to citizens reported domestic abuse, and inaction or discrimination by police during the year.

A woman may petition for divorce based on injury from abuse, but the law does not provide a clear legal standard regarding what constitutes injury. Additionally, a woman must provide at least two male witnesses (or a male witness and two female witnesses) to attest to the injury. There were no shelters or hotlines specifically for victims of domestic violence, although a temporary shelter for domestic workers housed victims during the year. The government completed construction of a high-capacity shelter for domestic workers in 2012, but the shelter was not fully operational by year’s end.

Harmful Traditional Practices: The penal code penalizes honor crimes as misdemeanors. The law states that a man who sees his wife, daughter, mother, or sister in the “act of adultery” and immediately kills her or the man with whom she is committing adultery will face a maximum punishment of three years’ imprisonment and a fine of 225 dinar ($790), slightly less than a month’s earnings at the public-sector minimum wage. Sentencing guidelines for honor crimes do not apply to Bidoon. In February the court convicted and sentenced five foreign residents to life in prison for the June 2012 “honor killing” of a 19-year old female family member.

Sexual Harassment: No specific law addresses sexual harassment, but the law criminalizes “encroachment on honor,” which encompasses everything from touching a woman against her will to rape, and police strictly enforced this law. The government deployed female police officers specifically to combat sexual harassment in shopping malls and other public spaces. Perpetrators faced fines and jail time. Nonetheless, human rights groups characterized sexual harassment against women in the workplace as a pervasive and unreported problem.

Reproductive Rights: There were no reports of government interference in the right of couples and individuals to decide freely the number, spacing, and timing of children. Decisions regarding access to contraceptives, family size, and procedures involving reproductive and fertility treatments required the consent of both husband and wife. The information and means to make those decisions, as well as skilled attendance during prenatal care, essential obstetric care, childbirth, and postpartum care were freely available. While the government did not provide any formal family planning programs, contraceptives were available without prescription to citizens and noncitizens.

Discrimination: Women have many political rights, including the right to vote and serve in parliament and the cabinet, but they do not enjoy the same rights as men under family law, property law, or in the judicial system. Sharia (Islamic law) courts have jurisdiction over personal status and family law cases for Sunni and Shia Muslims. Sharia discriminates against women in judicial proceedings, freedom of movement (see section 1.d.), marriage, and inheritance. Secular courts allow any person to testify and consider male and female testimony equally, but in the sharia courts, the testimony of a man equals that of two women.

The law prohibits marriage between Muslim women and non-Muslim men. The law does not require a non-Muslim woman to convert to Islam to marry a Muslim man, but many non-Muslim women faced strong economic and societal pressure to convert. In the event of a divorce, the law grants the fathers custody of children of non-Muslim women who fail to convert. A non-Muslim woman who fails to convert is also ineligible for naturalization as a citizen and cannot inherit her husband’s property unless specified as a beneficiary in his will.

Inheritance is also governed by sharia, which varies according to the specific school of Islamic jurisprudence followed by different populations in the country. In the absence of a direct male heir, a Shia woman may inherit all property while a Sunni woman inherits only a portion, with the balance divided among brothers, uncles, and male cousins of the deceased.

In June the National Assembly passed an amendment that gave divorced and widowed women additional house ownership and rent allowance rights and allocations, but authorities had not implemented the law by year’s end. In July the Ministry of Social Affairs and Labor granted a “housewife allowance” to nonworking women age 55 and older.

Female citizens remain unable to pass citizenship to their noncitizen husbands or their children; exceptions were made for some children of widowed or divorced female citizens. Male citizens married to female noncitizens did not face such discrimination.

The law states a woman should receive “remuneration equal to that of a man provided she does the same work,” although it prohibits women from working in “dangerous industries” and in trades “harmful” to health. According to international assessments, the average working woman earned 6,600 dinar ($23,385) annually, compared with 18,691 dinar ($66,231) for the average working man. Only 14 percent of managers, legislators, and senior officials were women. Educated women maintained the conservative nature of society restricted career opportunities, although there were limited improvements. Women comprise 72 percent of annual college graduates, according to statistics from 2011, but account for just 53 percent of the 270,000 citizens working in the public sector and 44 percent of the 60,000 citizens working in the private sector.

The law requires segregation by gender of classes at all universities and secondary schools. Public universities enforced this law more rigorously than private universities.

Two members of the 50-seat parliament elected in July were women. By early December a parliamentary committee for women’s and family affairs had not yet been established or staffed, although such a committee existed in previous parliaments. Some women attained prominent positions in business as heads of corporations. Two women served as ministers in the cabinet.

There were no female judges. For the first time, however, the Judicial Institute accepted 22 women during the year. Graduation from the institute is a prerequisite for employment as a prosecutor or judge.

Iraqis Draft Law Allowing 9 Year Old “Women” to Marry

BAGHDAD (AP) — A contentious draft law being considered in Iraq could open the door to girls as young as nine getting married and would require wives to submit to sex on their husband’s whim, provoking outrage from rights activists and many Iraqis who see it as a step backward for women’s rights.

The measure, aimed at creating different laws for Iraq’s majority Shiite population, could further fray the country’s divisions amid some of the worst bloodshed since the sectarian fighting that nearly ripped the country apart after the U.S.-led invasion. It also comes as more and more children under 18 get married in the country.

“That law represents a crime against humanity and childhood,” prominent Iraqi human rights activist Hana Adwar told The Associated Press. “Married underage girls are subjected to physical and psychological suffering.
Iraqi law now sets the legal age for marriage at 18 without parental approval. Girls as young as 15 can be married only with a guardian’s approval.

The proposed new measure, known as the Jaafari Personal Status Law, is based on the principles of a Shiite school of religious law founded by Jaafar al-Sadiq, the sixth Shiite imam. Iraq’s Justice Ministry late last year introduced the draft measure to the Cabinet, which approved it last month despite strong opposition by rights groups and activists.

The draft law does not set a minimum age for marriage. Instead, it mentions an age in a section on divorce, setting rules for divorces of girls who have reached the age of 9 years in the lunar Islamic calendar. It also says that’s the age girls reach puberty. Since the Islamic calendar year is 10 or 11 days shorter than the Gregorian calendar, that would be the equivalent of 8 years and 8 months old. The bill makes the father the only parent with the right to accept or refuse the marriage proposal.

Critics of the bill believe that its authors slipped the age into the divorce section as a backhanded way to allow marriages of girls that young. Already, government statistics show that nearly 25 percent of marriages in Iraq involved someone under the age of 18 in 2011, up from 21 percent in 2001 and 15 percent in 1997. Planning Ministry spokesman Abdul-Zahra Hendawi said the practice of underage marriage is particularly prevalent in rural areas and some provinces where illiteracy is high.

Also under the proposed measure, a husband can have sex with his wife regardless of her consent. The bill also prevents women from leaving the house without their husband’s permission, would restrict women’s rights in matters of parental custody after divorce and make it easier for men to take multiple wives.

Parliament must still ratify the bill before it becomes law. That is unlikely to happen before parliamentary elections scheduled for April 30, though the Cabinet support suggests it remains a priority for Prime Minister Nouri al-Maliki’s administration. Al-Maliki is widely expected to seek a third term.

Baghdad-based analyst Hadi Jalo suggested that election campaigning might be behind the proposal.

“Some influential Shiite politicians have the impression that they should do their best to make any achievement that would end the injustice that had been done against the Shiites in the past,” Jalo said.

The formerly repressed Shiite majority came to power after the 2003 U.S.-led invasion that ousted Saddam Hussein’s Sunni-led regime. Since then, Shiite religious and political leaders have encouraged followers to pour in millions into streets for religious rituals, a show of their strength.

Iraqi Justice Minister Hassan al-Shimmari, a Shiite, has brushed off the criticism of the bill. His office introduced a companion bill that calls for the establishment of special Shiite courts that would be tied to the sect’s religious leadership.

Al-Shimmari insists that the bill is designed to end injustices faced by Iraqi women in past decades, and that it could help prevent illicit child marriage outside established legal systems.

“By introducing this draft law, we want to limit or prevent such practices,” al-Shimmari said.

But Sunni female lawmaker Likaa Wardi believes it violates women’s and children’s rights and creates divisions in society.

“The Jaffari law will pave the way to the establishments of courts for Shiites only, and this will force others sects to form their own courts. This move will widen the rift among the Iraqi people,” Wardi said.

New York-based Human Rights Watch also strongly criticized the law this week.
“Passage of the Jaafari law would be a disastrous and discriminatory step backward for Iraq’s women and girls,” deputy Middle East director Joe Stork said in a statement. “This personal status law would only entrench Iraq’s divisions while the government claims to support equal rights for all.”
It is unclear how much support the bill enjoys among Iraqi Shiites, but Jalo, the analyst, believes that it would face opposition from secular members of the sect.

Qais Raheem, a Shiite government employee living in eastern Baghdad, said the draft bill contradicts the principles of a modern society.

“The government officials have come up with this backward law instead of combating corruption and terrorism,” said Raheem who has four children, including two teenage girls. “This law legalizes the rape and we should all reject it.”

From Yen to Compulsion

If you were to overhear conversations between AdventureMan and I, you would think we are whacko. It’s a funny thing about love; sometimes odd ducks can find one another and live happily ever after, or at least, have some really good times.

The other day we were on our way to lunch, and had no great preferences for going anywhere. We made a decision (and now I can’t even remember what it was, it was such a negligible decision) and AdventureMan said he kind of wanted to eat this, and I said his want was greater than my yen . . . . and off we went.

All the way to the restaurant, we were inserting words on a spectrum and debating now and then on their proper placement on the continuum. Like is a “yen” milder than a “want?” On the far end, does “obsession” precede “compulsion?” Is a compulsion truly related to a want at all, or does being driven to something take out the want-factor altogether? Yes, like I said, we are totally whacko, and thanks be to God, often whacko in the same direction, or we would drive one another totally crazy.

Here is our “want” line, from “yen” which we consider a very mild want, to compulsion, which drives out all other wants. We have probably left out some words you can think of, if you are a person who is still reading this far, please feel free to suggest amendments, or specific additions to make the line more flowing. “I Make Three Times What She Makes and She Wants To Talk About Chore Charts?!”

The man in the next booth was pushing all my buttons. The truth is, we don’t want to hear about his personal life. I don’t want to hear about anyone’s personal lives unless it is me and one of my oldest bestest friends, and we keep our voices down. Private lives are PRIVATE!

He is talking with someone, maybe his co-worker, and his entire monologue is about his failing relationship with his wife. I really don’t want to hear this.

And then he says “I make three times what she makes, and she wants to talk about chore charts???” and please, I need a pat on the back, I didn’t say anything, I didn’t get up and clock him, I didn’t even blink. AdventureMan laughed, he knew I was choking mad on the inside.

It doesn’t matter what you make, big man. If you are both working, you share the household chores. You both live there. You clean up your own mess, you pick up your own dirty clothes and put them in the laundry basket. You rinse your own dishes. You change the baby, you drive your son to his soccer game. It’s called teamwork.

Sure, I totally get division of labor. What I don’t get is this attitude of entitlement; like the fifties are long gone and we all work and we all share the duties of home and children and making it all work out at the end of the day. It’s never giving 50% – 50% – It’s always giving at least 75% – 75%.

We call it the Well of Good Will. If we were perfect people we wouldn’t need it, but we are people who screw up. We need mercy. We need forgiveness. So you give a little extra every day and hope that on a day when you fall short, there is enough on deposit in the well of good will that you can get a pass on your shortcomings for today.

If you are having a problem with your primary relationship, have a straight talk with that person. It doesn’t do any good to bad-mouth your spouse to a co-worker, and it certainly is not amusing to those of us forced to overhear. Ugh.

A TCK Wedding (Third Culture Kids)

Several years ago, back in my earlier blogging years, a Kuwaiti friend, Amer al Hilaliya wrote a wonderful post: I Am a Third Culture Kid, Are You? He never anticipated the result – comment after comment, some short, some a little bitter, some longer and insightful. The Third Culture Kids know who they are, and are eager to share their insights and experiences – but mostly with other Third Culture Kids, who understand.

Others . . . don’t get it.

This weekend, we went to a wonderful Third Culture Kids wedding. It wasn’t billed that way, but it was so thoroughly that way that I couldn’t stop seeing it. It doesn’t hurt that we are reading the seminal work on Third Culture Kids by David C. Pollock and Ruth E Van Renken called, yep, you guessed it, Third Culture Kids.

It’s almost like reading a whole new book. It has all the Third Culture Kids stories, but has expanded to include third culture kids cousins, like the adult third culture kids, ATCKs (those who have lived a goodly share of their lives in a non-native culture), cross culture adoptees, cross cultural marriages, etc. One of the points they make is that being third culture kids cuts across a lot of boundaries and makes for odd – odd by normal standards – friendships. Once again, across the boundaries – countries, old, young – friendships are determined by a commonality in experiences outside the native culture. It is a fascinating read.

People don’t think of how LONG Florida is, tip to tip, but from Pensacola to Fort Myers is a fuuur piece, as they say, even if it is on an inside curve. Thank God it wasn’t Key West! We thought it would be an eight hour drive, and it turned into thirteen, with heavy traffic from Lake City to Ft Myer.

The wedding was sweet, simple and heart felt. Both sets of parents had done significant missionary work in foreign countries, and the kids were definitely third culture kids. The groom would speak Turkish in his sotto voce asides to his best man, who grew up with him on the streets of Ankara. The bride’s brother read all the greetings and best wishes to the bride from her friends in Hungary – and he read them all in Hungarian.

Just as the ceremony started, along came a pirate ship! Some things, you just can’t plan, they just happen.

They all told family stories, and one of them stuck in our hearts because it reflects our own experiences growing up in the Moslem world. The groom, as a young man, came home flustered because a woman on the metro, as he was coming home, noticed he was not wearing an undershirt under his T-shirt, and assumed he was a homeless child. She started talking with all the other passengers, and they marched him off the train to the souks, where they insisted on buying him an undershirt (who knew that you were not properly dressed in Turkey unless you were wearing a sleeveless undershirt?) and also a sweater, to keep him warm on the streets. All this, in spite of the fact that this homeless boy spoke excellent Turkish and kept telling them he had a home! No! No undershirt, he has to be homeless.

Few people in America know the kindnesses we experience living in the Moslem world. It may not always make sense to us – in Tunis, we always wondered if we were getting the annual Eid platter of lamb and couscous showed up because we were thought to be poor or because we were strangers? There has always been a sweetness and generosity to our Moslem neighbors that humbled us. Because of the layering upon layering of these kindnesses, we see Islam, and the Middle East, differently from most of our American friends who have never lived among Moslems. Maybe if we all knew one another a little better, we would have less cause to fear one another, and maybe without all that fear, we could manage a little less hatred.

What is a wedding without babies and children to remind us of the Circle of Life (which AdventureMan calls The Circle of Death). This little one speaks English and Turkish already, and loved the sugar white sands of Ft. Myers Beach and the little seashells, just her size.

As more and more people cross borders, for work, for play, for marriage, for education, as we live in ‘alien’ cultures and learn other ways of thinking, maybe we are growing into an entire world with a larger viewpoint?

Every time I read this Psalm, from today’s Lectionary readings, I see something new. Today it gives me much to ponder in the midst of chaotic Thanksgiving preparations:

“Mind Your Own Business”

You can be married for a long time and still be surprised. 🙂

 

I was thinking about other cultures, and then I thought about growing up in Alaska. Alaska is one of those kind of end-of-the-line places. Maybe it’s changed, but except for the native Americans, most people had come from somewhere else. Very few were second generation.

 

People at end-of-the-line places often have backstories they don’t want to talk about – bad divorces, or worse – bad marriage –  no divorce, criminal records, or a million other situations they don’t want to talk about. From an early age, you learn not to ask. There were also a lot of laconic Scandinavians around; they talk about fishing and hunting but are seriously tongue-tied if asked a personal question. So again – you learn not to ask.

 

“Mind your own business,” I can remember my own mother saying, so I thought it was a rule. “Don’t be a Nosey-Parker.”

 

All my life I thought that was the rule. It was the way I was raised. Every now and then that curtain of pre-conceptions parts and a light gleams through. I was thinking about other cultures and it occurred to me to ask AdventureMan if he grew up with the same rule.

 

He just laughed.  He looked at me in utter amazement, and laughed.

 

“I grew up in a town of 3,000,” he laughed, “and some of those were relatives, aunts, uncles, grandparents, cousins – everyone knew everything!”

 

“There’s no such thing as ‘mind your own business’ when your entire life is known by every single person in town!”

 

He hooted with laughter at the very thought.

 

 

“Everyone knew everything!” he repeated.

 

It’s expat world right here in my own house. This is a whole new way of thinking about things. I’ve always thought personal privacy was sort of universal, but not so.

 

One of the many times we lived in Germany, we lived in a small village where people told us everything. It was amazing, a whole different world, being on the inside, but not really being a part of it all. People seemed to feel we needed to be filled-in. One family didn’t speak to another family in the village, and it was awkward, because there were only like 300 people in the village, but many years ago someone’s grandmother had a terrible disagreement with the other family’s grandmother and no one in the families speak to one another now, even though no one can remember the reason.

 

I’ve escaped a lot of that being an expat, not sticking around longer than five years max, not long enough to develop a reputation you can’t shake. 🙂 But it makes me wonder if things are looser these days, if you can grow and change and be allowed to outlive your mistakes in small places where everything is everyone’s business . . .

A good, productive and stable marriage is built on one’s ability to love someone else and make sacrifices for that person. We in this region as a whole are sometimes very materialistic and usually wealthy. Many a time couples get married for the wrong reasons. Sometimes because marriage is the new “thing to do”, it’s merely the new toy. Maybe the honeymoon period is the only highlight of the whole affair.

Lawyer Waleed Khaled Al-Dousari was talking to the Arab Times on marriages in Kuwait, exploring the causes behind the increasing rate of divorces in the society. “The rate of divorce in Kuwait has reached more than 50 per cent, and the number is still on the rise,” he adds.

Q: How would you describe marriage in Kuwait, and have the trends changed?

A: Traditionally, the ideal marriage was tribal, related families encouraging their offspring to marry cousins or other relatives in order to increase and strengthen the tribe, or occasionally to marry into another tribe in order to heal rifts between families. Another reason for such marriages was that families knew the background of the partner.

As is the case in some Latin countries, young couples in the region are allowed to meet under the watchful eyes of a chaperon. In Kuwait, however, the marriage is arranged without any part of the girl’s body (including her face) being seen by the prospective groom, who must rely on the reports of his female relatives as to his wife’s appearance.

There are three main elements in an Arab marriage. First, the groom must discuss and agree the dowry with the bride’s father. This might include gold, jewelry and clothing and is usually of considerable valuable. After the dowry settlement, comes the actual marriage contract, which is conducted by a legal or religious representative.

The bride is asked in the absence of the prospective groom if she agrees to the marriage and this question is then put to the groom. After the agreement, the groom joins hands with his future father-in-law and, with two witnesses present, the marriage becomes official.

However, there’s another stage before the couple actually meet as man and wife: the wedding party. Celebrations are segregated, with the women in one section of the house or private ballroom and the men in another. Finally, on the last night of celebrations, the couple meets, accompanied by all their friends, and eventually leaves for their honeymoon. On their return, they either live with the groom’s parents and become members of the extended family or – as is increasingly the case – set up a separate home by themselves.

According to Sharia, a Muslim man may have four wives, provided that he can look after them materially and treats them equally. This practice is now dying out, however, not only because only a few can afford it, but also because women are becoming more independent and assertive and many refuse to accept it.

In fact, a Muslim woman can insert a clause in the marriage contract that restricts her husband from marrying another woman for as long as the contract is valid. The wife also retains her own name after the marriage.

Although gender roles have always been clearly defined in the Islamic world, with the man as ‘provider’ and the woman as ‘nurturer’, both the man and the woman are increasingly going out to work, although this is much less common in Saudi Arabia, where there are restrictions on women working, except in culturally ‘acceptable’ occupations such as medicine and teaching. However, many Saudi men are reluctant to marry doctors and nurses, who have physical contact with male patients.

A man can divorce his wife simply by saying ‘I divorce you’ three times. He can rescind the divorce if this was done in the heat of the moment, but only if the wife agrees (and only on three occasions though). On the other hand, even if a wife has a good reason to seek a divorce (e.g. if her husband has been unfaithful, abused or deserted her, or engaged in criminal activity), she must go to a court for the case to be heard.

The husband must maintain a divorced wife and any children from the marriage if the wife is unable to support herself. He can claim custody of any sons when they reach a certain age; however, the priority is given to the mother, but this still depends on the sect of the couple. A female divorcee usually returns to her family, and few remarry.

Although a Muslim woman may not marry a non-Muslim man unless he converts to Islam, the reverse isn’t the case. Non-Muslim women are often pressurized into converting, and there have been many cases of foreign women marrying Arabs and then discovering that the local culture and lifestyle are unacceptably restrictive. It should also be noted that, in the event of the breakdown of such a union, the children are usually kept by the husband in his home country.

Expatriate workers can usually be married in the Gulf, provided that they meet the civil and religious requirements of their home country. Embassy and consulate staff sometimes performs civil marriage ceremonies, again provided that certain requirements are met. Religious ceremonies can be arranged, but only in countries that allow churches or similar non-Muslim places of worship.

Although many young citizens in Kuwait are still seeking the blessing and help of their parents for choosing life partners, some youngsters in Kuwait prefer finding their partners without parental guidance and mediation. This approach is the result of cultural interactions. This changing trend has become quite noticeable in the countries of the region.

Q: Why are we currently encountering an increasing rate of divorce in the country?

A: A good, productive and stable marriage is built on one’s ability to “love” someone else and make sacrifices for them. We in this region as a whole are sometimes very materialistic and usually wealthy. Many a time couples get married for the wrong reasons. Sometimes because marriage is the new “thing to do”, it’s merely the new toy. Maybe the honeymoon period is the only highlight of the whole affair.
In some cases, both partners may be in need of intimacy and so they get married to have that kind of intimacy. There’s nothing wrong with that. In fact in this arrangement, there is one good thing in that youngsters feel that they should “get married first” before “becoming intimate with anyone”. That’s a noble and encouraging thought.

But after the first few months or the first couple of years, we start noticing the first signs of trouble, and you see both sides contemplating the “D” word. They think “I don’t need this.” And rightly so, they really don’t need it. Both are wealthy, both have high paying jobs, their rooms in their parents’ houses are still empty and perhaps are still untouched with their original furniture in place and in tact.

Other reasons, however, come along due to the change in the definition of marriage as a whole from the perspective of both men and women. Even families in Kuwait today no longer feel shameful that their daughter or son is divorced. Some families are actually encouraging their daughters to divorce, because sometimes that divorce gives her more financial gains than she already has.

In Kuwait, it is a huge problem when a man cannot provide a luxurious life to his wife. It is his duty to provide her with the maid, driver, shopping every now and then, and the ability to travel at least on a yearly basis.

However, not all Kuwaitis are able to provide this kind of lifestyle for their wives and children.
Another issue is that of cheating. There is a huge increase in the percentage of cheating wives and husbands. It has become so easy for a husband or wife to cheat on each other, especially because marriages are neither based on love nor respect.

The high divorce rate in Kuwait insinuates that we are too spoiled to remain stuck to our marriages.
So what will happen to us in say 50 years? The world will be less dependent on our oil, and the oil will become less abundant anyway. We will become poorer in general. Isn’t that right?

We will have less materialistic “toys” to play with. And therefore we will be less spoiled. And I think we will tend to stay committed to our marriages more.

Our men will start actually doing some “work” to earn a living. And less of these jobs will be suited to women, and women will have less incentive to leave the umbrella of her husband’s (modest) financial security. Just like the times of our grandfathers and grandmothers.

Now, this might be a bleak picture, but maybe with less material distractions, and with healthier marriages, I only see us becoming happier people.

Q: So what happens, when a couple comes asking for a divorce?

A: From my experience as a lawyer, the usual scene when two couples ask for a divorce is that they come to my office in the image of two enemies who completely hate each other, and cannot even stand being in the same room with each other.

The women usually tries to file as much cases against her husband to get all the rights that she wants, and the man tries to do the same thing.

Q: What is the role of Shari’a law in divorce cases? Is there a difference between the rights that a woman may take if she was Sunni or Shi’ite?

A: In Kuwait we abide by the Islamic Sharia law when it comes to marriage or divorce. Therefore, when a couple asks for a divorce, usually there are certain proceedings that should take place.
To apply for divorce, you should be of sound mind and be able to make your own choices.
The first step the couple should do is to register the case at the Moral and Family Guidance Section at the court.

Shortly afterwards, a counselor will meet the couple and discuss their problems. They are then given a three-month time to try and solve the problems, before beginning the divorce process.

If the couple, or either of them, still insists on divorce, the papers will be forwarded to the court for the judge to study the case. The judge will discuss it with the couple and listen to the witnesses. It could take a couple of sessions before the judge makes his decision. The couple needs to attend all the proceedings.

A woman may be granted a divorce if she can prove that her husband has physically hurt her or mentally tortured her. A woman also may sue for divorce if her husband abandons her for a period of three months, or if he has not taken care of her needs or that of their children.

The law allows women to obtain a khula – a separation, when she returns the dowry to the husband.

The Sharia Court will accept a divorce lawsuit from Muslim men or Christian or Jewish women married to a Muslim and apply the Islamic laws.

If the divorce applicants are both Muslims, but from different countries and are residents in Kuwait, they will be divorced according to the administrative laws in their country, or the Kuwaiti law, whichever they wish. While Sharia is same in all Muslim countries, there are a few administrative differences between the various schools of thought.

If the couple is from the same country, the law of their country, will be applied or the Kuwaiti law may be applied, if they so wish.

If the husband is a Muslim and the woman is not a Muslim, the Kuwaiti laws will be applied, or the law of the country where they had got married will be applied.

If the couple is non-Muslim, they can seek divorce according to the law of their country, at the embassy or consulate.

There is not much difference between the two sects when it comes to divorce; there is only one main difference, and that is a Sunni women can take the custody of her children without ever having to return them to their father. However, the father can be with his children on previously arranged days.

According to the Shi’ite sect, the father can take his children when the children reach the age of seven or above, by which time the children too have a say in that kind of decision.

However, even the issue of custody is abused by some women, who place a huge financial burden on the man under the pretext of asking for the children’s upkeep. Some women do so despite being financially well off themselves.

Q: Can you give us examples of some divorce cases in Kuwait?

A: One intriguing divorce case involved a woman who divorced her husband on their wedding day because she found out at the wedding ballroom that groom had not made the costly arrangements that she had asked for, and instead chose a reception that cost much.

Some women get divorced because they see divorce as a financial gain for them. Men are sometimes forced to provide his divorcee with a house, a maid, a driver, and a monthly alimony for her and her children.
In many cases the reasons are very silly, which makes it very difficult for us lawyers to take any stand on the issue. For example one woman filed for a divorce because she didn’t like the way her husband made sounds while eating.

Q: What do you think is the role of society to tackle the problem of increasing divorce rates? How can education help reduce the rate of divorce, or help couple’s understand and appreciate the true value of marriage?

A: In light of high rates of divorce cases, social authorities should play a role in educating youth about the basic criteria for sound marriages. Grassroots associations and the media in the Gulf have to educate families about potential negative aspects of coercing young males and females to marry relatives, in the first place, and also how arranged marriages can have very harmful results on both couples, especially as they might not be suitable for each other.

Most of the persons I have met expressed desire to marry non-relatives, thus affirming the idea that parents must refrain from coercion. Moreover, to by taking away the right of youngsters to choose their life partners is against religious values and common sense.

Some official reports estimate that divorce cases in Kuwait are at 50 percent, and the phenomenon has been linked to diverse factors related to modern-day developments in the country, and western concepts and values and post-oil-boom social transformations.

Most males in Kuwait tend to get acquainted with the would-be “soul mate” personally while the majority of the females favor the parents’ role in this regard.

In Kuwait, we are starting to have many welfare societies that are helping couples to refrain from divorce as much as possible. However, the problem is that we do not have the right education concerning marriage in the country.

Neither families nor schools educate children on marriage or even give them the chance to fall in love and make their own choices of who they want to get married to.

We need to set a proper age limit for marriage for both males and females, because some are getting married at a very young age, such as 17 and 18. This is also leading to the great increase in divorce rates. The proper age for males to get married should be between 26 and 30, and that for the females should be above 20. However, that is only my opinion.

As to the qualifications of the would-be partner, the couples should believe in commitment. They should be educated. There is the need to be attracted to the physical appearance of each other and not be forced to get married to people they don’t know. Then of course financial capacities and employment are important factors. These are not the most important issues though.
